A comparative study of Ayatollah Motahhari’s views on Jihad and Rawls’ views on Humanitarian Wars

Abstract

Since there appears to be a relationship between Ayatollah Mutahhari’s ‘Jihad’ theory and John Rawls’s Humanitarian War theory, and between their shared social concerns, this study aims at investigating whether the two theories are similar or different in terms of legitimacy of war and the use of force. It seems that humanitarian jihad and liberal humanitarian intervention have a similar genesis, the difference being that the former is prescribed on theological foundations and the latter is founded on ethical liberalism, though the two have similar claims. Can this apparently unprofessed resemblance in permissibility of jihad in Jihad theory of Ayatollah Motahhari – as a Muslim jurist and philosopher - and the justification of war to confront violation of human rights in “The Law of Peoples” as a complement to theory of justice of Rawls – as a Kantian liberal philosopher be considered a significant relationship? چکیده نسبتی ناخواسته میان نظریه جهاد شهید مرتضی مطهری و جان رالز و مشابهت برخی دغدغه‌های اجتماعی آن‌ها بهانه‌ای است برای کنجکاوی در امکان تشابه یا افتراق نظریه این دو در باب مشروعیت جنگ و توسل ابتدایی به زور. در این بررسی به نظر می‌رسد جهاد بشردوستانه آن گونه که از نامش پیداست سنخیتی با مداخله بشردوستانه دارد؛ با این تفاوت که اولی از منظری ایدئولوژیک و الهی تجویز می‌شود و دومی از منظر لیبرالیسم اخلاقی؛ گر چه هر دو تقریباً مدعای یکسانی دارند. آیا این تشابه علی الظاهر ناخودآگاه در میان موارد تجویز جهاد در نظریه جهاد شهید مطهری به عنوان یک فقیه فلسفه‌گرای مسلمان و توجیه جنگ برای مقابله با نقض حقوق بشر در «قانون مردمان» به عنوان مکمل نظریه عدالت جان رالز، به عنوان یک فیلسوف لیبرال کانت‌گرا نقطه‌ای مشترک و پیوندی وثیق محسوب می‌شود؟
