ADMINISTRATIV AND LEGAL PRINCIPLES OF DELEGATION OF LAW-ENFORCEMENT FUNCTION OF THE STATE BY MINISTRY OF JUSTICE OF UKRAINE

Abstract

The article is devoted to definition of administrative-legal mechanism of realization of law enforcement function of the state by the Ministry of justice of Ukraine. As the Ministry of justice of Ukraine is one of the largest and most influential ministries, such which is any activity of a democratic state in the legal sphere, the rule of law and the rule of law. Legally, the Ministry of justice acts as the independent subject of authority, which has its own administrative status, functions and tasks. One of which is the implementation of the state policy in the field of criminal punishment execution and probation. For implementation of vkazanikhzavdan’ at Ministry of justice Administration functions criminally executive services of Ukraine and Public institution “Center of probation”. In same queue state criminally executive service of Ukraine in accordance with a law carries out pravozastosovni and law-enforcement functions. In same queue Public institution “Center of probacii” is unprofitable public institution, created for providing of implementation of tasks of State criminally executive services of Ukraine on questions probacii and direct direction and co-ordination of activity of the authorized organs on questions probacii, that belongs to the sphere of management of Min’yustu. Activity of Center of probacii is sent and co-ordinated the Deputy of justice of Ukraine minister in accordance with distributing of duties. It can also be noted that diversity is vested in the Ministry of justice of functions and tasks has led to the use of a wide range of powers in the sphere of state legal policy, first of all, the delegation of law enforcement functions of the state through divisions. As a result, the implementation of the Ministry of justice the law enforcement function of the state is to create adequate conditions for citizens, foreigners and stateless persons of their rights, protecting their rights while serving criminal sentences and probation.
