المال الحرام فقه التصرف فيه والتعامل مع أصحابه

Abstract
يتناول هذا البحث قضية من القضايا المهمة والمعاصرة في حياة كل مسلم، ألا وهي قضية المال الحرام، كيفية التصرف فيه، وكيفية التعامل مع أصحابه، فقد يكتسب المسلم المال الحرام لسبب من الأسباب سواءٌ أكان بقصد أو بغير قصد، ثم يرغب في تطهير ماله، والتخلص منه وفق الأحكام والقواعد الشرعية، أو قد يتعامل المسلم مع أصحاب المال الحرام، فيحتار في كيفية التعامل معهم دون الوقوع في الحرام. من خلال البحث أحاول الإجابة عن هذه الإشكالية عبر تقسيم الموضوع إلى ثلاثة أقسام، القسم الأول خصص لبيان مفهوم المال الحرام عند العلماء واختيار التعريف الراجح له، ومن ثم بيان أقسام وأنواع المال الحرام. أما القسم الثاني فنشير فيه إلى المصارف الشرعية الممكنة للتخلص من المال الحرام، ونذكر خلاف العلماء في جواز إنفاق الحائز للمال الحرام على نفسه، أو استخدامه له، والشروط الواجب توفرها لجواز ذلك. أما القسم الثالث والأخير فأشرنا فيه إلى أهم قواعد التعامل مع أصحاب المال الحرام، سواء أكان المال مالاً حراماً خالصاً أو مختلطاً بالمال الحلال، وسواء أكان متيقناً من وجوده، أو مشكوكاً فيه.
