The article covers practice of the EU Court and the European Court on Human Rights, were the main EU principles of criminal justice have been stipulated – such as subsidiary principle, proportionality principle, mutual recognition and loyal co- operation principles, respect to human rights, a balance between private and public interests, ne bis in idem principle.
