Abstract
In accordance with the Polish labour law, social arbitration is the last amicable stage in the resolution of collective disputes. Arbitration may be carried out on the basis of an appropriate application, which only the employee site is authorized to submit. In order to start arbitration the employer is forced to wait for the trade union to make a decision. Arbitration is a non-mandatory form of liquidation of a dispute. Therefore, the article discusses the voluntary nature of arbitration in the context of examples of legislation of selected European countries. The work also includes the analysis of the use of social arbitration in Poland and the role of a trade union organization at the stage of arbitration.
