[b][i]Penalization of the Private Sector Corruption as an Example of the Public Protection of the Private Sector[/i][/b]

Abstract

Criminal law is universal, which means that it refers to relations within both public and private sectors. As far as corruptive behaviour is concerned, historically only the public sector corruption was penalized in the Polish criminal law. However, the situation has recently changed. The purpose of this paper is to analyze the process of criminalization of private sector corruption in the Polish criminal law. The aim of this process was to provide criminal law protection for relations in the private sector similar to the protection provided for relations in the public sector. The process was related to the internationalization of the Polish criminal law. As a result, a new offense of private sector corruption was introduced into the Polish Penal Code (Art. 296a).
