Brexit a arbitraż w Wielkiej Brytanii

Abstract

Brexit and arbitration in Great Britain The issue of the article is related to the process of withdrawal of the United Kingdom from the European Union. In a referendum on 23 June, 2016, Britons voted to leave the EU. On 29 March, 2017, the UK government invoked Article 50 of the Treaty on the European Union. The UK is thus due to leave the EU on 29 March, 2019. Leaving the European Union triggers the need to make arrangements on the provisions applicable thereafter. The scope of these considerations is limited to arbitration proceedings. The author will try to predict the impact of Brexit on the frequency of choosing Great Britain as a seat of arbitration proceedings and identify factors supporting the development of London based arbitration tribunals. The key issues related to post-Brexit arbitration concern, inter alia, admissibility of issuing anti-suit injunctions, recognition and enforcement of arbitral awards, enlarging the catalog of premises enabling setting aside arbitral awards, to name but a few.
