«BURDEN OF PROOF» AND «DUTY OF PROVING» IN CIVIL PROCEEDING OF UKRAINE — CORRELATION OF TERMS

Abstract
The article investigates different approaches of procedural law mavens to understanding of the essence of such concepts as «burden of proof» and «duty of proving» in civil judicial procedure, as well as the author made the analysis of existing approaches to understanding of these terms in regard to their conformity with the civil procedural legislation of Ukraine and court practice.
