CHARACTERISTICS OF DAMAGES UNDER UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS, 1980

Abstract
The article reveals the characteristic category of damages in accordance with the provisions of the UN Convention on Contracts for the International Sale of Goods. It is emphasized that the damages are a form of contractual liability stricto sensu under the Convention. It is noted that many of the characteristics of damages in the Vienna Convention have evaluative nature, requiring the analysis of not only the factual circumstances, but taking into account a number of subjective assessments. In this regard, despite the availability of unified standards, the needs of practice for application of the Convention provisions on the damages is often decided by bringing instruments of applicable national law.
