CONTRACT OF TRANSPORTATION THE CARGO: FEATURES AND ESSENTIAL CONDITIONS

Abstract
The article is devoted to the characterization of the contract of transportation the cargo and the distinction of such features: the parties are the carrier (a legal entity or individual-the entrepreneur) with a special legal personality, which is defined by the Law of Ukraine “On Transport” and the customer (shipper and consignee). Analysis the norms of the Civil Code of Ukraine and the Law of Ukraine “On Road Transport”, we can determine the following essential conditions of the contract of carriage of goods, as: the subject of the contract (services for loading, transportation and unloading of goods); price/shipping fee according to the contract of carriage of goods, which is determined by the carrier depending on the weight of the cargo, kilometer mileage, etc.; the period of delivery of the cargo, which covers the period from the moment of delivery of the cargo to the carriage, the location of the goods on the road and ends with the arrival of the goods to the destination.
