CRIMINOLOGICAL CHARACTERISTIC OF CRIMES IN THE SPHERE OF MANUFACTURING AND CIRCULATION OF MEDICINES

Abstract

The article gives a criminological characteristic of crimes committed in the field of manufacturing and circulation of medicinal products, with the disclosure of quantitative indicators of the state and structure of the indicated crime. As a result, the conclusion is drawn on the inadequate effectiveness of the work of the departments of the Department of Economic Protection of the National Police of Ukraine on the detection of crimes committed in the field of manufacturing and circulation of medicinal products, as evidenced by the relatively small number of accounted for 2011–2018 crimes in this category, a significant number closed proceedings for accountable crimes, etc. In particular, it turns out that most falsifiers of medicines manage to escape from liability, since a small number of criminal proceedings of this category comes to court. In addition, the author carried out the classification of crimes committed in the field of manufacturing and circulation of medicines. It is especially emphasized that the problem of criminality in the field of manufacturing and circulation of medicines has an interdisciplinary character and is being investigated in the pharmaceutical, legal and forensic fields. The author concludes that there is a need for comprehensive criminological research of crime in the field of manufacturing and circulation of medicines. The article also gives an author’s definition of crime in the field of manufacturing and circulation of medicinal products, under which the author understands the crime in the pharmaceutical industry, which is a combination of criminal prohibited socially dangerous encroachments related to the industrial production of medicinal products, the manufacture of medicinal products within pharmacies, wholesale and retail sales of pharmaceuticals through pharmacy networks, specialized sales and distribution. Finally, in the article, the author summarizes the main ways of receipt of counterfeit medicines in the pharmaceutical market of Ukraine, and also emphasizes the expediency of developing effective measures for the detection and prevention of crimes committed in the field of manufacturing and circulation of medicinal products.
