Discovering the ports. Notes on the maritime legislation and the regulation of the Argentine harbor system, 1941-1949

Abstract
The present article analyzes the frst steps from the Argentine State to control the harbor system and to elaborate a national marine policy, understanding them in terms of the preoccupation of the State in the port, mercantile and fshing activities. We focus on the analysis of the public policies and their legal regulation around the ports during the 40‘s, specially noting the conception of the activity like a “public service” and in the consequent advances and backward movements in its process of nationalization and monopolization. In this sense, we will go through the period between the creation of the Merchant Fleet of the State and the nationalization of the Rosario port during the government of Ramon Castillo; and the defnitive state monopolization of the Argentine ports and the marine transport during the frst government of Juan D. Perón. Consequently, we will try to reveal the ruptures and the continuities around the harbor policy, as well as the impediments at the time of legislating these activities as a whole.
