До питання перспективи приватних установ виконання покарань в Україні / To the Issue of Perspectives of the Private Institutions for the Execution of Sentences in Ukraine

Abstract
This article is devoted to the study of the prospect of the establishment of private institutions for the execution of sentences in Ukraine. In the article the practice of introduction and functioning of the institute of private prisons in foreign countries, history and problems that arose during its creation were considered. It is also concluded that this institute can be implemented in Ukraine. Initially, the article deals with the issue of modern reforming of the penitentiary system of Ukraine and analyzes the Cabinet of Ministers of Ukraine Resolution No. 654-p "On Approving the Concept of Reforming (Development) of the Penitentiary System of Ukraine", namely the problems of the penitentiary system and public-private interaction in the field of execution of sentences . Also, the article lists the possible types of public-private cooperation. After this, the authors review the experience of establishing private prisons in foreign countries, namely in the United States, Britain, France and Israel. The advantages of private institutions for serving sentences against state institutions in these countries are presented. The reasons for the establishment of private prisons in these countries were considered. In addition, the problems encountered in the establishment and existence of the institution of private prisons, in particular: the inefficiency and incompetence of employees of private institutions for the execution of sentences, the exploitation of prisoners' work, corruption links, the unconstitutionality of some provisions for the existence of private prisons, are highlighted. In addition, an alternative to private prisons was considered on the example of the Kingdom of Switzerland.
