DONATION AND TRANSPLANTATION IN ASPECT OF PATIENTS' RIGHT

Abstract
The article is devoted to legal problems of donation and transplantation. The following types of donation are singled out: 1) blood, its components; 2) human organs, their parts or other anatomical materials; 3) reproductive tissues. Within this article, we will analyze the first two defined types. We will determine the main aspects of the right to blood donation and its components in Ukraine. The following criteria for realization of the right to the donation are distinguished: medical, legal, social. Models of legal regulation of donation after death are investigated. It is proved that Ukraine needs to move away from the model of consent in favor of a model of the assumption of general consent.
