Abstract
The Federal Arbitration Act is a cornerstone in the evolution of the American arbitration. The initial version of the act held that arbitration agreements shall be valid, irrevocable, and enforceable, save upon such grounds as exist at law or in equity for the revocation of any contract. Nowadays, the FAA creates a body of federal substantive law that is applicable in both federal and state courts. Congress enforced a strong national policy favoring arbitration agreements. It resulted, among others, in the controversial widespread use of arbitration clauses in consumer and employment contracts, upheld by the Supreme Court of the United States. Furthermore, most recent development in American arbitration involves declaring the class action waiver found in a consumer contract of adhesion valid and enforceable.
