Executing the corrupt of the earth in the viewpoint of Islamic denominations (Imamiyyah, Shafi’i, Hanbali, Maliki, Hanafi)

Abstract

Paying attention to justice and the liability of the wrongdoer is one of the bases of punishment in Islam. Violating the principles of respect, gaining illegitimate benefits and destroying the feeling of security and tranquility in the society are big offenses that the criminal perpetrates as a consequence of doing the crime. As a result, the criminal system is after establishing justice, opposing suppression and confronting the criminal so that the just conditions which existed prior to the happening of the offense may return once again. The present paper is entitled “Executing the corrupt of the earth in the viewpoint of Islamic denominations (Imamiyyah, Shafi’i, Hanbali, Maliki, Hanafi)”; the research method is descriptive – analytical and explores the execution of the corrupt of the earth as interpreted by the Islamic denominations. The results show that among the different denominations, the Shiites adopt a more logical and rational approach toward punishment, and have only stipulated execution as a punishment for some of the capital crimes and offenses. In the Islamic thought, there are worldly purposes for capital punishment (execution) which is paying attention to the social life. As regards execution and its conditions, it can be stated that the principles, rules and viewpoints of the Imamiyyah, Shafi’i, Maliki and Hanbali jurists is very close to and in accordance with each other. However, the thoughts of Hanafi jurists in most cases have differences with other denominations.
