FREEDOM OF RELIGION AND CONSCINCE; THE CONTENT OF THE CONCEPT FROM MARSILIUS OF PADUA TO MODERN CONSTITUTIONAL STATE

Abstract
So as to comprehend the freedom of religion and conscience estimated undercategory of civil liberties, significance of freedom and civil liberties must be refered primarily. Thus content of freedom of religion and conscience, and authority and responsibilities those state burdened with can be revealed. As a civil liberty, freedom of religion and conscience had found its first statements within the studies of Marsilius of Padua. Philosopher who based the separation of church and state affairs on civil society theory had formed the first position of modern constitutional state in relation to religion and secularism theory. Necessarily secularism theory must be revealed and limits of individual and state must be understood for defining the actions of constitutional state about freedom. In addition to this mentioning historical texts and international treaties expressed the freedom during the historical process will corroborate understanding of topic.
