FUNCTIONS OF MUNICIPAL INSPECTIONS WITH WELLBUTHOOD FOR PROVISION OF ENVIRONMENTAL RIGHTS IN UKRAINE

Abstract

This article explores the legal status of inspections for the improvement of settlements in Ukraine and their role in ensuring environmental rights of citizens. In particular, the functions and powers of municipal inspectors for improvement in the environmental sphere are analyzed, taking into account the current legislation of Ukraine. It was stated that in modern conditions, municipal inspection inspectors have a number of powers to organize and provide improvement within settlements. Municipal inspectors for the improvement of settlements do not have exclusive functions in the field of environmental protection, since their main task is to improve the settlements in general. The conclusion is made about the legal nature of the control functions of inspections, which are an element of self-regulatory control over the provision of improvement in general and indirectly aimed at ensuring the fundamental rights of citizens in various areas. At the same time, they carry out control ecological functions, which are an integral and extremely important component for the provision of improvement in general and indirectly play an important role in guaranteeing the environmental rights of citizens, in particular the rights of everyone to a clean and safe environment for life and health, the rights on free access to environmental information, and the right to compensation for environmental damage. The main forms of implementation of the self-regulatory environmental monitoring of municipal inspections of landscaping include: conducting inspections of the territory; consideration of appeals of enterprises, institutions, organizations and citizens; participation in the discussion of projects for the improvement of the territories of settlements, other technical documentation on the issues of improvement and the introduction of relevant proposals for consideration by local authorities, enterprises, institutions, organizations; Submission of lawsuits to the court on compensation for damage caused to objects of improvement as a result of violation of legislation on the improvement of settlements.
