Generation of human rights and their effects on the establishment and transformation of the constitutional-legal status of human and citizen

Abstract

The article examines the generations of human rights in the context of their direct influence on the formation of the constitutional and legal status of a person and a citizen. The purpose of the article is to investigate the role and influence of human rights generations on the establishment and transformation of the constitutional and legal status of a person and a citizen. Scientific novelty. The arguments presented in their logical sequence actualize and objectify the problems of the human rights generations and their influence on the dynamics of the legal status of the human being in the context of its expansion and improvement in the conditions of the development of legal democratic statehood, which has a powerful humanistic and humanitarian component. It has been determined that human rights generations are formed in the doctrine of constitutional law of states and in international law in historical retrospect in order to emphasize the attention of states and the international community to the particular importance of the respective groups of rights, to actualize their recognition, legalization, protection, protection, implementation and guarantee. Conclusions. A systematic analysis of these human rights generations shows that they are, first of all, organically integrated and reflecting the humanistic and humanitarian foundations of the modern concept of human rights. Secondly, with the separation of each of the new generations of human rights, a new approach to the individual actually emerges, not only as a natural being, but as a proper subject of law and subject of legal status. Regarding the last perspective, which is actually the purpose of the research being conducted, it should be noted that such a conclusion is of significant methodological and praxeological importance, which is confirmed by the activities of both national states and the whole international community on the activation of processes of normalization, normalization, normoprojection of human rights at international and national levels. Fourth, such activity is not mechanistic in nature, it is characterized by a relativistically complex and creative approach when new human rights modernize its constitutional and international status toward its expansion and improvement - but not haphazardly, chaotically, but demonstrating a clear a management paradigm aimed at: a) adequate normalization of such human rights; b) creation of a system of normative-legal (constitutional) support and securing of such rights for the purpose of their practical realization; c) "fitting in" the relevant human and citizen rights belonging to the category of human rights generations to a single harmonized system of constitutional rights, which, in turn, d) directly influences the extension and improvement of the constitutional and legal status of the person and citizen, assisting in consolidation mechanisms for their implementation and guarantee at the national legislative and international contractual and regulatory levels.
