GENESIS OF THE DEATH PENALTY ON THE TERRITORY OF UKRAINE

Abstract
The article examines the retrospective application of the death penalty, as a form of punishment, in accordance with the criminal law that was in force in the territory of modern Ukraine. The authors analyze in detail the provisions of the legislation relating to this issue starting from the “Russian Pravda”, ending with the current Criminal Code of Ukraine. In the course of the study the provisions of the following legal acts are covered: “Russian Pravda”, Statutes of the Grand Duchy of Lithuania (1529, 1566, 1588 years), “The rights of which are handled by the Malorosian people”, the Military article of Peter I, the Code of Penalties, Criminal Code, and the Criminal Codes USSR 1922, 1927, 1960 and others.
