Government as the basis of purchase of ownership right to residential premises

Abstract
In the article the main problematic aspects of the gifting of residential premises as the basis for acquiring property rights are analyzed, the main positions on the issue of preserving the right to use the dwelling space for a donor in the case of donating a dwelling to another person are described, the problem of violation of the housing rights of minors at the conclusion of a gift contract. The author investigates the mechanism of the rule, which fixes the guarantee of ensuring the rights of minors, provides recommendations for the elimination of legislative gaps.
