IMPLEMENTATION OF INTERNATIONAL LAW NORMS OF PROTECTING DISCRIMINATION IN THE NATIONAL LEGISLATION OF UKRAINE

Abstract

Problem setting. The national legislation of Ukraine in the anti-discrimination sphere and the status of Ukraine's fulfillment of its international legal obligations as a member state of the Council of Europe and other international organizations, taking into account ECRI's recommendations, are examined. The basic directions of improvement of the legislation in the field of combating discrimination have been established, in particular, concerning the need for the establishment of a special coordinating state body on combating discrimination; amendments to the Criminal Code of Ukraine (Article 161) regarding the establishment of protection for foreigners and stateless persons, which is also an important condition for Ukraine's integration into the EU. Analysis of recent research. The question of interpretation, provision and the principle of equality and non-discrimination, in particular in decisions of yhe ECHR, devoted their work to such domestic and foreign researchers, as O. Vasilchenko, O. Vashanova, D. Gudima, N. Dremin-Volok, B. Nedelok, N. Onishchenko, S. Pogrebnyak, P. Rabinovich, S. Rabinovich, M. de Salvia, A. Sultanov, O. Uvarov, G. Khristov, S. Shevchuk. However, given the complexity and diversity of such problems, it is necessary to state that there is an urgent need for further scientific research on this issue. Article’s main body. Co-operation within the framework of the Council of Europe on combating discrimination is essential for the improvement of national legislation in the field of human rights protection, in particular the prevention of various forms of discrimination, and, therefore, for the development of a democratic, rule-of-law state and civil society. The use of the best organizational and legal practices in the fight against xenophobia and racism, which are formed as a result of the active influence of the Council of Europe itself and of the organs and organizations whose activities are aimed at achieving its goals, enables our state to integrate into a single European legal space where uniform standards are in place. the field of human rights protection.
