Improvement of the legal protection on cultural heritage in the Ukrainian SSR (1940 – 1950)

Abstract
The purpose of the article is to analyze the specifics of the legal regulation on cultural heritage protection in the Ukrainian SSR in the postwar years. Scientific novelty. According to the results of normative acts analysis, the specifics of the legal regulation on the protection of cultural heritage in the Ukrainian SSR in the postwar years were revealed. The main directions of legal regulation on cultural heritage protection in the period under review are highlighted. Conclusions. The specificity of the development of the legislation on the period under review is the elaboration of its principles in the Union center and the adoption of all-Union documents, which were largely duplicated by the relevant acts of the Union republics. At the same time, the Ukrainian SSR, whose monuments were most affected during World War II, actively pursued its own conservation activities, developing, among other things, the necessary regulations. In the legal and legal support for the protection of cultural heritage in the Ukrainian SSR during the war and post-war period, three main areas can be conditionally distinguished: 1) restoration of the activity of historical and architectural reserves and creation of new museums and reserves; 2) legal support for the perpetuation of the memory of those killed during the Second World War and previous wars; 3) improvement of the system of accounting and registration of objects of cultural heritage. In general, during this period, a number of important documents were developed and approved, including the resolution of the RNA of the Ukrainian SSR in 1944 «On the return of museum exhibits», the resolution of the RNA of the Ukrainian SSR and the Central Committee of the Communist Party (b) In 1945 «On measures to streamline the state of cultural monuments, of antiquity and nature in the territory of the Ukrainian SSR», resolution of the RNA of the Ukrainian SSR in 1948 «On measures to improve the protection of cultural monuments in the territory of the Ukrainian SSR», Instruction on the procedure for accounting, registration and maintenance of archaeological and historical monuments in the territory of the Ukrainian SSR 1950 and others, not only have made it possible to rebuild and restore the monuments damaged during the war, but also to adjust the process of accounting, registration, protection and preservation, thereby saving for the descendants important cultural assets created by their precursors over many centuries.
