Інстанційна юрисдикція адміністративних судів в контексті судово-правової реформи в Україні / Instance Jurisdiction of Administrative Courts in Terms of Judicial Reform in Ukraine

Abstract

The article investigates and clarifies the essence and content of the jurisdiction of administrative courts of Ukraine, taking into account changes that were introduced into the administrative procedural legislation in the context of judicial reform in Ukraine. It is established that a court instance is a judicial body as a whole or its structural subdivision, which performs a certain procedural function in the administration of justice. The court instances for resolving disputes are different in terms of procedural powers. In administrative proceedings there are the court of first instance, the appellate court (appellate instance), and the court of cassation (cassation instance). The scope and extent of the competence of the competent court of each court branch for the consideration and resolution of administrative cases in the first, in the appellate and cassation instances is considered and determined. So, the rules of the instance jurisdiction of administrative cases constitute an algorithm for determining the competent court for consideration and resolution of a particular case. In the case of defined jurisdiction, the answer is given to the questions, which courts deal with cases in the first instance, and which - in the appellate and cassation instances. The legislation establishes which court has the right to conduct each individual proceedings and describes their functions. So, the instance jurisdiction determines the powers of the court of each separate unit of the unified system of the court system of Ukraine: local courts, appellate courts and the Supreme Court.
