ІНСТАНЦІЙНІСТЬ СУДОВОГО РОЗГЛЯДУ АДМІНІСТРАТИВНОГО ПОЗОВУ ЯК ГАРАНТІЯ ЗАБЕЗПЕЧЕННЯ ПРАВ І СВОБОД

Abstract

In the article the author raises questions of the definition and solution of the problems of the regulatory legal regulation of the patronage service in Ukraine. The author raises the problems of the need for legislative determination of the status of assistant judge. It is determined that the current legislation is rather fragmentary and incompletely solved problems of the regulation of public relations associated with the admission and dismissal of an assistant judge, as a result leads to legal uncertainty of the relevant procedures. The author underlines the necessity of forming special norms of legislation in the part of establishing human rights and freedoms. The right to appeal and cassation appeal of a court decision made by a court of first instance, belongs to the basic constitutional rights, has a general character, is inalienable and inviolable. The theoretical basis of the article is the works devoted to the development of the problems of the court proceedings of the administrative claim as a whole, and within the limits of separate instances. A cassation appeal can be defined as a special institute of administrative procedural law, which unites administrative procedural rules that regulate cassation proceedings in administrative proceedings. In its turn, administrative cassation proceedings are objectification of a cassation appeal in the form of successive actions aimed at revealing the correctness and lawfulness of the application of the rules of substantive and procedural law in the decision-making process by lower court administrative courts; its connection with the administrative process is that the cassation proceedings are “an optional stage of the administrative judicial process, which is a set of administrative procedural rules that govern the procedural relations associated with the verification of the legality of court decisions of the court of first instance after their review in the appeal procedure, as well as court decisions of the court of appeal in whole or in part”.
