Abstract

The article delves into problems which aroused around a conclusion of CETA by the EU and Canada, which was formally signed by the officials of both parties on 30 October, 2016. Institution of consultation was analyzed in the last article. In order to attain the full spectrum of issues of dispute resolution, as provided for in this regulation, arbitration will be analyzed. The characteristics of this issue prompt lavish contemplations upon Chapter 9, Section C, Under section A, entitled “Procedures for settlement of disputes”. Arbitration issue, which was not yet broadly commented as an alternative dispute resolution, is fundamental for proper perception of international law in this respect. For parties of such treaties a possibility to solve a dispute consensually is pivotal. The differences between the Canadian and European regulations entailed creating the new, supranational system of law. As a consequence in order to attain a whole spectrum of this matter the following facets have been adumbrated – general provisions, specific provisions with annexes to the agreement, as well as a remainder of international agreements to which the parties refer therein. These elements had to be analyzed altogether. A concluding part comprises of a proper assessment of the arbitration in CETA.
