INTERNATIONAL CRIMINAL TRIBUNAL FOR YUGOSLAVIA

Abstract
This article deals with the creation process by the Security Council Judicial Institute, analysis of the stages of the creation and operation of the International Tribunal for the Former Yugoslavia. The main problems the functioning of the International Tribunal for the Former Yugoslavia have been clarified. The emphasis is on analyzing the resolutions of the Security Council Judicial Institute, which is basis for creating a Tribunal. Were highlighted the problems of effectiveness and objectivity of the International Tribunal for the Former Yugoslavia. Further argued illegitimacy of the tribunal’s work and its creation. A legal analysis of the seventh chapter of the Security Council Judicial Institute Charter was conducted, referring to which the Tribunal was created. Was defined the role of the International Tribunal for the Former Yugoslavia in the development of the international criminal justice system and its impact on the emergence of the International Criminal Court and hybrid courts. It was carried out the analysis of bibliographic sources devoted to the activities of the tribunal. There are two main problems faced by the Tribunal after its foundation.
