INTERNATIONAL LEGAL BASIS FOR PROVISION OF NATIONAL SECURITY OF UKRAINE

Abstract

The issues of international and national safety are considered in the context of system display of principles of its realization. National security is a dynamic, evolving concept. Although there is some variation across countries, the meaning of term “national security” is quite similar across national plans and it refers to protecting nations and citizens. The term “national security” represents a coherent concept that has an internationally understood meaning. The issue of international dimension of national security and its standards is considered. Have been determined and analyzed and the number of the theoretical conclusions as to the investigated sphere of the state policy improvement have been formulated. These standards are those as defined in international human rights treaties and in other international instruments agreed by states under the auspices of the United Nations, the Council of Europe and the OSCE. For this research it is important to consider the actual impact of globalization on the state, law, security and human rights. Based on international standards, states develop national plans and strategies. These plans and strategies define national security, identify sources of threat and provide blueprints for assignment of roles and cooperation at the international, national and sub-national levels in managing security related risks. All of the plans reviewed use the term “national security” as the central concept. National security law establishes the way that each state handles threats to its government, its values, and its very existence. The main objective of most international instruments is to promote the standardization of national security legislation. But, the world is not yet a place where globally coordinated action will produce a world-wide web of legal means of counteracting threats to national security. Integration into Euro-Atlantic area with the aim of acquiring membership in North- Atlantic Treaty Organization was determined as one of the priorities of the national interests of Ukraine.
