International legal obligations of Ukraine concerning the protection of labour and social rights of the seafarers

Abstract

In the modern Ukrainian legal literature there are no complex theoretical re- searches and developments on issues of international legal standards of the protection of labour rights of the seafarers. From the beginning of the 90th years of the 20th century this subject has been explored mainly on the basis of periodical publications. During the Soviet period this subject hardly was developed. Researches of such standards in the area of the protection of labour and social rights of the seafarers, their role in securing global issues of the labour and social rights of the seafarers in the world is an actual topic which has both theoretical and practical aspect. Modern national legislation doesn’t fully recognize the obvious fact that international labour market in maritime industry is rather specific and Ukraine plays an important role on it. In labour relations, which arise in the area of maritime transport, internationalization is very important. The pointed ten- dency led to the awareness of the need of the international legal regulation of the labour of the seafarers. The main role in such regulation plays the protection of the labour rights of the seafarers which cannot be performed through efforts of individual States. Its efficiency depends first of all on joining the national means to the international collaboration at the universal and regional level. Thus creation and observance of the international legal labour standards of the seafarers became the issue at the international level, which can be solved only within the framework of the interna- tional collaboration. The article presents some main international conventions focusing on issues of the pro- tection of labour and social rights of the seafarers, and specificity of their influence on Ukrainian legislation. Also the compliance of Ukrainian legislation with its international legal obligations in the area of the protection of labour and social rights of the seafarers is analysed.
