Abstract
The author analyses the evolution of the institute of supply its specific characteristics and essence according to current Ukrainian legislation within the context of dualism of private law in Ukraine. On the basis of the conducted analysis the author comes to conclusions that there is a need to improve private law in Ukraine in the sphere of the trade. The article describes the study of the subject material supply agreement, as the basis of division with the purchase agreement and determine the legal nature of the delivery as a business agreement. Found that the features of the subject contract for the supply of railway transport is the branch orientation and branch codification of each item that is purchased. The article is devoted to the definition of the features of the supply contract, which by its legal nature is a complicated and, at the same time, an effective form in which property relations can be transformed and which is least regulated by the current economic legislation. The application of this agreement to the provisions governing the sale contract is inadequate, and in some cases unacceptable. Legislative requirements for the regulation of the supply agreement, in particular, its subject, status, parties, order of conclusion, terms of execution and liability for breach of contract conditions, are required.
