LAW REGULATION IMPROVEMENT OF ORGANIZATION AND HOLDING REFERENDUMS IN UKRAINE

Abstract
The article is devoted to the research of the legal regulation of the organization and holding of referendums in Ukraine and to the suggestions for improving the current Ukrainian legislation to bring the rules in line with European standards. It is proved that the current Law of Ukraine "On All-Ukrainian Referendum" does not establish the proper procedure for conducting an all-Ukrainian referendum from the point of view the rule of law; does not ensure the implementation of procedural guarantees the legality of its results; gives the authorities opportunity to manipulate the formation of people's will. Established the necessary to recognize political parties and public organizations as referendum process subjects, the need to change the administrative procedure for forming commissions of referendum to a party or a competitive one and to increase quorum of participation and approval decisions in the commissions of referendum. Particular attention is paid to justifying expediency liberalization of signatures collection procedures and establishing a quorum of support for the referendum's decisions in more than 50 % of voters.
