LEGAL CERTAINTY AND ITS TEMPORAL MANIFESTATIONS IN PRIVATE EUROPEAN LAW

Abstract
The article analyses the doctrinal approaches to the essence and content of the category “legal certainty” in the European and Ukrainian legal systems. The main principles and the order of its application at the stages of lawmaking and law enforcement are studied. Individual constituent elements of legal certainty are investigated with the aim of achieving theoretical and practical unambiguousness of their content and purpose in legal regulation. It is established that the application of legal certainty in legal acts and judicial verdicts guarantees ensuring the clarity of the grounds, goals, clarity and unambiguity of their content, especially those that are directly addressed to citizens. A person in accordance with the requirements of this principle, guided by legal acts, should be able to confidently provide for the legal consequences of his behaviour. Legal certainty is also designed to ensure the stability of legal relations, predictability, stability and unchanging judicial decisions, is an integral part of the effective protection of participants in public relations. On the other hand, being too regulated, legal certainty can cause excessive rigidity of regulation. Therefore, the paper suggests approaches to achieve an appropriate balance between these factors. Considering that part of the guarantees that make up the content of the right to a fair trial is not mentioned in Art. 6 of the 1950 Convention, they are worked out and interpreted by the case-law of the European Court of Human Rights. Under these circumstances, it is recognized as the basis for an official international interpretation of the Convention. Consequently, the work analyses the procedure of applying court orders in the Ukrainian legal system. Numerous shortcomings of national lawmaking and legal proceedings were noted, and ways for their improvement were suggested. A particular attention is paid to temporal characteristics that are a part of the commented principle and determine the certainty of the legal norm and judicial decision in view of their movement in time. The practice of using temporary factors of legal certainty in national law is analysed, and specific recommendations are proposed for adapting European regulations to it.
