LEGAL LIABILITY AS THE FORM OF THE STATE-LAW PRIMUS: CONCEPT AND CHARACTERISTICS

Abstract
In the article the author finds out and reveals the specific features of legal responsibility as a form of state-legal coercion, formulates its concept. Among the specific features of legal liability as a form of state-legal coercion are: 1) connection with state coercion; 2) implementation on the basis and within the limits of the law; 3) the offensive only if the necessary grounds exist; 4) the procedural form; 5) realization only by specially authorized subjects; 6) expression of the obligation to experience a particular type and extent of deprivation of the benefits of personal, property, organizational nature. Legal liability as a form of state-legal coercion is defined as prescribed by the norms of law and carried out in a procedural form by specially authorized subjects, punitive measures, which are applied, provided that there are necessary grounds for the subject of violation of subjective rights (offenses).
