LEGAL NATURE OF GUARANTEES RELATED WITH THE CRIMINAL PROSECUTION OF A LAWYER

Abstract
In this paper, an analysis the legal nature of guarantees, which indicate the existence of a special order of criminal proceedings against a lawyer. The necessity of their existence is argued as one of the conditions that provides an opportunity for the professional activity of a lawyer on the basis of absolute independence. Attention is drawn to the presence of inaccuracies and gaps, as well as to the actual lack of proper procedure for their implementation, which in fact makes impossible their full application.
