LEGISLATIVE APPROACHES ON THE CONCEPT AND FEATURES OF FOODSTUFFS

Abstract

Annotation: in this scientific article the concept of a food product is disclosed. A distinction is made between the functional food product and the food product for special dietary intake. The concept of baby food is defined. Attention is drawn to the gaps and collisions in the food law. Proposed changes and additions to the Law of Ukraine "On Basic Principles and Requirements for the Safety and Quality of Food Products". It is proposed to remove nutritional supplements from the notion of food products contained in the law of Ukraine "On the safety and quality of food products". But to pass the Law of Ukraine "On Food Additives", in which to formulate the concept and fix the types of dietary supplements, their purpose. Control over their use, addition to food products. Establish a system of subjects of control of public administration. Determine the system of liability for violating the norms of the addition of food additives to food products, or use in the process of manufacturing food products forbidden nutritional supplements. We believe that dietary supplements are a concentrated source of nutrients (amino acids, proteins, lipids, vegetable oils, carbohydrates or products of animal or plant origin) that are consumed orally or added to food in addition to the usual diet in small quantities and are considered necessary for a man Accordingly, we propose to make amendments to the definition of "dietary supplements" to Art. 1 of the Law of Ukraine "On Basic Principles and Requirements for the Safety and Quality of Food Products". At the same time, to Art. 321 "" Functional food product "of the said law, the following additions are to be made. "Functional food product is a type of food intended for the prevention and treatment of human disease and contains certain components of medicines. Functional nutrition is a systematic daily use of certain products of special purpose, the origin of which can be both natural and artificial, and their property is to fill the deficiency of nutritional substances created in the body as a result of pregnancy, diseases, including chronic, sports workouts Such products regulate the biochemical reactions and physiological functions in the human body, thus influencing and psychosocial behavior. As a result, they improve the overall physical condition and reduce the risk of patrology. A food product for special dietary use is a specially processed or developed product aimed at a dietary person of a person with a specific physical or physiological state or specific illness or disorder, including infant food, nutrition athletes and the elderly. The composition of these products is different from the composition of conventional products, but is not a substitute for medicinal products. "Art. 1 of the Law of Ukraine "On Infant Nutrition", make the following changes: "Baby food is a special food product to meet the dietary needs of infants and young children"
