LEGISLATIVE GROUNDS OF THEATRICAL AND CONCERT EVENTS ON THE TERRITORY OF UKRAINE: ECONOMIC AND LEGAL ASPECT

Abstract
A perfect legislative grounds for relationships in the field of cultural and educational activities, including the property and economic basis of the functioning of the relevant institutions, is one of the most important factors of state-legal influence in this sphere. Determination of the peculiarities of the economic legislation system on the regulation of theatrical and concert events in Ukraine. The tangible economic nature of the norms of the relevant legislative and subordinate acts in this area is reasonably noted. They are based, in particular, on the requirements for the establishment and financing of theater and concert institutions and organizations, the order of their logistical support, the gaining and use of income from their own economic activity, the use of advertising materials, observance of the rules of operation of buildings, engineering systems and warning systems, provisions of the legislation on copyright and related rights, protection of consumers’ rights, etc. It is proved that the legislative provisions in this area have got economic nature. Sub-legislative regulation, based on the operative management tasks facing the respective state executive bodies that adopt them, cannot provide stable and well-established regulation in this branch. The necessity of fixing the clear provisions of the law on conducting touring-concert events is substantiated. This will eliminate the fluctuations of legal influence, which undermine the legitimate basis of the activities of cultural institutions and theaters. There is indicated the complexity of economic-legal norms which regulate the investigated relationships. The rules are different in origin and in the essential affiliation of sources of law, and at the same time are characterized by very wide application of sublegislative acts and blanket norms. Thus, the conclusion about the inability of the existing legislative framework to fully ensure the steady development of theater and concert activity in Ukraine is made.
