Lethal Prisons: Ecuador and the Denial of Human Rights in the Penitentiary System

Journal Title: Revista Científica ConCiencia Jurídica - Year 2025, Vol 2, Issue 2

Abstract

Ecuador's penitentiary system is facing an unprecedented crisis, marked by extreme violence, severe overcrowding, and the collapse of its rehabilitative function. Through a qualitative approach and a methodology based on documentary review, this study analyzes how necropolitical logic has permeated prisons, turning them into spaces of death and torture, where state omission reinforces structural violence. The research examines the evolution of Ecuador’s penitentiary system, the militarization of prisons as a failed strategy, and the impact of criminal governance within detention centers. The findings reveal that prisons have ceased to serve as spaces for social reintegration and have instead become environments where life is devalued. The study concludes that the prison crisis in Ecuador is not only a security issue but also a manifestation of social exclusion and the systematic violation of human rights.
