The J. A. Schumpeter’s Theory of Innovation and Patents’ Trolls

Abstract
There is no doubt that intellectual property should be protected because they are particularly vulnerable to „steal”. However, under the law for some time made The exploitation of „protection” only legal way to profit by „not practicing entities” (the NPE’s) also called patent trolls. Patent protection is closely linked to the process of innovation in the economy which is described in the theory of innovation by J.A. Schumpeter. The purpose of this article is to describe the abuse of intellectual property rights protection for companies that are „non-practicing entities” (patent trolls) in the light of innovation theory of J.A. Schumpeter.
