Abstract
Preventive arrest is the detention of the accused / defendant in custody in the places and conditions prescribed by law. This is an exceptional measure that can be applied to the accused / defendant while taking into account the principle of the presumption of innocence or, as is apparent from the European Convention on Human Rights and the judgments of the Court, the appropriate preventive arrest must be the appropriate risks proved.
