Organizational and legal aspects of advising dispute responsibility protectors

Abstract

Introduction. The prosecutor's office is one of the main institutes of law, order and protection of human rights and national interests in Ukraine. At the same time, in the organization of the work of the prosecutor's office, the human factor has always been relevant, one of the manifestations of which is the admission of disciplinary violations by prosecutors. Thus, the actual task of jurisprudence is the substantiation of organizational and legal aspects of prosecutors being brought to disciplinary responsibility. Purpose. The purpose of the work is to substantiate the organizational and legal aspects of bringing prosecutors to disciplinary responsibility. Results. The essence and elements of the process of bringing prosecutors to disciplinary responsibility are explored. The importance of separate components of the system is emphasized in order to achieve a balance between the interests of the public prosecutor and the public, the implementation of the principle of a fair trial. The practice of publishing the decisions of the Qualification-Disciplinary Commission of Public Prosecutors from the point of view of balancing approaches to protecting confidential information, transparency of the functioning of the prosecutor's office and social and educational influence is analyzed. Conclusion. It is proved that the actual task of improving the organizational and legal provision of prosecutors disciplinary responsibility is to improve the method of detection and encryption of confidential information that may be contained in decisions. Additionally, it was recommended to amend the Regulations on the procedure for the work of the Prosecutors' Qualifications and Disciplinary Commission with the aim of clarifying the availability of information on bringing prosecutors to disciplinary responsibility. A promising direction for further research is the justification of a method of preventing disciplinary misconduct among prosecutors.
