Особливості продовження строку тримання під вартою в контексті Європейських стандартів / Peculiarities of Extension of Detention in the Context of European Standards

Abstract
The article deals with provisions of criminal procedural legislation regarding extension of detention in the context of European standards. It has been noted that the issue of protection of the right to freedom and personal inviolability during extension of detention is not so new because this institute was also proscribed by the Criminal Procedure Code of Ukraine of 1960. Attention has been focused on the issue of extension of detention after termination of pre-trial investigation before 2012. It has been underlined unclear and irresponsible provisions of the Criminal Procedure Code of Ukraine of 1960 regarding extension of detention resulted in abuse and systematical violations of human rights. This situation was followed by the set of decision of the European Court of Human Rights against Ukraine. The case ‘Kharchenko v. Ukraine’ has been addressed. Existing provision on peculiarities of extension of detention has been investigated. It has been noted that its wording could correct and improve approaches of law enforcers to the extension of duration. But deep rooted attitude of prosecutors and investigators to this issue on the mental level based on arbitrary provisions of the Criminal Procedure Code of 1960 does not allow to use properly the tools of effective legislation. Attention to the research ‘Prosecutor’s Role on the Stage of Pretrial Investigation’ which was done in 2016-2017 has been focused. Two interviews with investigative judges on the quality of reasoning of relevant petitions have been presented. The Case of the European Court of Human Rights ‘Ignatov v. Ukraine’ has been considered. Problems of extension of detention during preliminary case hearing have been addressed. The decision of the Constitutional Court of Ukraine of November 23 2017 has been investigated. Relevant proposals on amendments to effective legislation have been made.
