Abstract
UK Розглянуто загальні ознаки службової особи як спеціального суб'єкта злочину за кримінальним правом України. Проаналізовано нормативне визначення поняття службової особи, загальні ознаки суб'єкта злочину як осудність та неосудність, обмежена осудність, вік кримінальної відповідальності, а також особливості визнання службової особи суб'єктом злочину за чинним Кримінальним кодексом України. Проведено огляд спеціальних питань визнання особи службовою, розглянуто питання про визнання (невизнання) відповідної особи службовою у кримінально-правовому сенсі. Проаналізовано ознаки, які притаманні службовій особі як спеціальному суб'єктові складу злочину. EN The general features of official as a special subject of crime under Criminal law of Ukraine. The regulatory definition of officer, the general features of the perpetrator as sanity and insanity, limited responsibility, age of criminal responsibility, and especially the recognition of official offender under the current Criminal Code of Ukraine have been analyzed. The review of special issues on recognition of person as an official, the question of recognition (non-recognition) of the person concerned officer in the criminal legal sense.
