PODMIOTY UPRAWNIONE DO UWIERZYTELNIANIA ODPISÓW DOKUMENTÓW W POSTĘPOWANIU ADMINISTRACYJNYM

Abstract
W artykule przedstawiono zmiany w postępowaniu administracyjnym jakie wprowadziła ustawa z dnia 23 października 2009 r. o zmianie ustaw w zakresie uwierzytelniania dokumentów. Autor dokonuje analizy powszechnej praktyki uwierzytelniania dokumentów przez pracowników organów administracji publicznej na tle stanu prawnego obowiązującego przed i po wejściu w życie ustawy nowelizującej. Omawia zagadania intertemporalne dotyczące obowiązywania nowych rozwiązań w stosunku do postępowań będących w toku. Wskazuje na błędy organów administracji publicznej w procesie stosowania prawa i ostatecznie odpowiada na pytanie kto w aktualnym stanie prawnym jest uprawniony do uwierzytelniania dokumentów oraz pełnomocnictw w postępowaniu administracyjnym.
