Abstract
In February 2012 an Italian flagged oil tanker Enrica Lexie participated in the incident concerning the Indian fishing boat St. Anthony. As a result two Indian fishermen was dead at sea, approximately about 20.5 nautical miles of Indian coast. This event started a dispute about criminal jurisdiction over two accused Italian marines responsible for the shooting. In the light of diplomatic tensions between two States, in July 2015 the case under the provisions of Convention on the Law of the Sea from 1982 was submitted to the International Tribunal for the Law of the Sea. The main issue concerning the Enrica Lexie incident is to determine the answer to the question whether the criminal jurisdiction over two marines is entitled to the coastal State or the flag State. Analysis of the international law of the sea leads to the conclusion, contrary to the opinions of Indian government, that Italian marines should be trailed by the flag State. In the Enrica Lexie Case the key issues are: the status of the waters where the incident occurs, the application of the territoriality principle and other general rules refer to the criminal or civil jurisdiction in the law of the sea.
