PROBLEM PROOF OF RISKS IN THE SELECTION PRECAUTION OF DETENTION

Abstract
The problem of insufficiency of the risk assessment by the prosecution side when choosing a preventive measure in the form of detention was investigated. Determined by the position of supporting European Court of Human Rights concerning the appointment of this preventive measure, and what specific practical problems occurring in Ukraine. A suggestion has been made on how this problem can be addressed by amending the national legislation and applying the legal conclusions of the European Court of Human Rights.
