ПРОБЛЕМНІ АСПЕКТИ ПРАЦЕВЛАШТУВАННЯ ТА РОБОТИ НЕПОВНОЛІТНІХ

Abstract
The author, analyzing the current legislation of Ukraine, examines the problematic aspects of employment of minors and determines ways to increase the level of employment of young people. The emphasis is placed on the fact that the labor law regulating social relations between the employer and the hired minor employee can only be realized through legally significant activities of the subjects of such legal relations. Finding a workplace, decent working conditions, and meeting the quality of education in future employment are the most acute and topical issues for minors. The need to identify problematic issues of employment of minors and the identification of ways to solve them is due in the first place to the presence of characteristic age-related physiological and psychological characteristics that determine their increased vulnerability. Consideration of procedural peculiarities of the mechanism of protection is essential for solving the problematic issues of employment of minors. Regulatory acts regulating the legal relationship between the employer and the minor worker are intended to ensure decent working conditions and to protect against harmful effects on life and health. Domestic legislation guarantees minors, as well as adults, a certain amount of rights, namely the right to: safe working conditions, in accordance with the requirements of the legislation; fair wages annual leave; judicial protection of labor rights, etc. The author stresses the necessity to consolidate at the legislative level the most effective, the one that corresponds to the present, mechanism of youth involvement in work. The state should actively take measures to promote the creation of youth labor centers and civic organizations whose purpose would be to ensure the employment of minors.
