PROBLEMS OF THE ENFORCEMENT OF JUDGEMENTS UNDER REFORMS IN UKRAINIAN JUDICIARY

Abstract
The article is focused on a comprehensive functionary study of the State Executive Service in Ukraine. The historical and social determinants of the State Executive Service in Ukraine, the main stages of the formation of the legal foundations of its activities have been identified and characterized. Characterized in a historical retrospective and specifics of the model of the State Executive Service in Ukraine in the system of public authority. The place, role and basic principles of enforcement of decisions in the activities of the State Executive Service in Ukraine are determined. The peculiarities of the foreign experience of the legal regulation of the activity of representatives of state bodies in enforcement proceedings are studied. The essence of the modern legal regime of enforcement proceedings and guarantees of observance of human rights is theoretically substantiated. Elements of executive production and their implementation by the State Executive Service in Ukraine are characterized. The executive documents on decisions subject to compulsory execution of the State Executive Service in Ukraine are systematized and considered. The content of legal guarantees for the activities of state executors and the procedure for bringing them to justice are disclosed. The main provisions of the modern concept of development of the State Executive Service in the conditions of the domestic mixed system of execution of decisions are developed. The directions of increasing the effectiveness of the organization of the State Executive Service in Ukraine in modern conditions are proposed. Prospects for improving the regulatory and legal regulation of the activities of the State Executive Service in Ukraine are determined.
