PROPOSALS FOR THE AMEDMENT OF REGULATORY LEGISLATION FOR THE IMPLEMENTATION OF CRIMINAL LIABILITY FOR UNLAWFUL ENRICHMENT

Abstract
There has been investigated the necessity of subsidiary application of norms of the regulatory legislation for the purpose of the implementation of criminal liability for unlawful enrichment. There has been grounded that making proposed amendments to the anti-corruption legislation of Ukraine will provide the opportunity to implement the procedural proving of existence or absence of the circumstances that meet the criteria for the elements of crime provided for by art. 3682 of the Criminal Code of Ukraine, thus ensuring the efficiency of practical application of the corresponding article.
