Protection of rights and interests of the employed and unusual forms of employment in the social market economy

Abstract

European Union is promoting various forms of untypical jobs, considering them effective method for counteracting unemployment, on condition of providing all employed persons with effective social welfare. Untypical jobs offer relatively low social security, poor collective protection, and they are performed by socially handicapped persons, such as women, immigrants, unqualified workers, etc. Such persons are more exposed to breaches of their rights and interests than traditional contract employees. Such approach, assuming combining flexibility of employment market with social security, is presently defined in Europe as “Flexicurity” concept. That concept is an attempt to combine employment flexibility with possibly high social security and protection of their tangible and intangible interests. Achievement of balance between flexibility of employment and social security of persons performing untypical jobs is a priority of both European Employment Strategy and Lisbon Strategy. EU Directives play critical role in this respect.<br/><br/>
