PROVIDING GOVERNMENT GUARANTEES AS A RISK OF CREDIT SUPPORT FOR AGRICULTURE: LEGAL QUESTIONS

Abstract
The article is devoted to the study of the legal issues of providing state guarantees as a direct line of state credit support of agriculture in Ukraine. The author reveals the legal features of this type of support of agricultural enterprises. Based on the research carried out, the author concludes that the agricultural protection potential of providing state guarantees for the fulfillment of credit obligations by agricultural enterprises is significant. The author researches the historical-legal aspect of the formation of such a type of credit support as the provision of state guarantees for the implementation of credit obligations by agricultural enterprises. The scientist reveals the problematic aspects of guaranteeing agro-credit obligations, traces ways of overcoming these problems and accumulated debts of agricultural enterprises to the state. The author makes a scientific analysis of the foreign experience of provision of guarantee support in the field of agricultural lending. The author analyzes the successful examples of foreign experience in providing state guarantee support to agricultural enterprises. The scientist makes the conclusions about the necessity of creation of proper specialized institutional and legal support for the provision of state guarantees for the implementation of credit obligations by agricultural enterprises. There is a thesis about the necessity of assigning functions to provide farmers with state guarantee support to a special state credit agent in the article. The author proves a need to organize the State Agrarian Bank for the maximum effective provision of systemic state credit support. It is necessary to assign to this special state agent the functions of carrying out all preparatory actions, risk assessment, conclusion of warranty contracts and collection of debts. The author proves that the amount of money allocated for providing state guarantee support in agriculture provided separately from funds aimed at guaranteeing obligations in other areas.
